Gibson Loses Lawsuit Attempt Against Guitar Hero

Posted by Alex | Filed under: All Format

Gibson claimed that Activisions Guitar Hero Controllers infringed on a patent they filed in 1999, but this claim was thrown out of the US District Court of Central California.

Judge Mariana R. Pfaelzer said in her ruling: “No reasonable person of ordinary skill in the relevant arts would interpret the ‘405 Patent as covering interactive video games”
“Gibson would have this Court determine that any device that controls something that produces musical sounds is covered by the ‘405 Patent.”

It has been said that Gibson’s lawsuit attempt is down to Activisions choice not to renew its branding deal for the Guitar controller peripheral, as the controllers no longer carry the Gibson brand and logo.
